Nominee vs Legal Heir — Key Difference
Key insight: LIC will pay the nominee directly. But if other legal heirs dispute, they can claim the money from the nominee through court — unless the nominee is a "beneficial nominee."
What is Beneficial Nominee? (Section 39(7))
The Insurance Laws (Amendment) Act, 2015 introduced the concept of "beneficial nominee" under Section 39(7). This is a game-changer:
- Spouse (husband/wife)
- Children (son/daughter)
- Parents (father/mother)
These nominees are treated as beneficial owners — other heirs generally cannot claim the money from them.
- Siblings (brother/sister)
- Friends
- Extended family
- Any other person
These nominees receive the money but hold it as trustees — legal heirs can claim it through court.
4 Common Scenarios — Who Gets Paid?
LIC pays wife. She is a beneficial nominee — she is the rightful owner of the claim. Other relatives (brothers, parents) generally cannot claim the money from her.
LIC pays brother (nominee). But brother is not a beneficial nominee — he is only a trustee. Wife (legal heir) can go to court and claim the money from brother.
LIC pays the legal heirs, but they must produce a succession certificate or legal heir certificate from court. This process can take 3-12 months and costs money. Always register a nominee!
LIC pays the appointee (guardian designated in the policy). The appointee manages the money until the child turns 18. An appointee is mandatory when the nominee is a minor.
How to Add or Change Nominee
Carry original policy bond and your ID proof (Aadhaar/PAN).
Provide new nominee's full name, relationship, date of birth, Aadhaar number, and percentage share (if multiple nominees).
LIC stamps the new nomination on your policy bond as proof. Keep this safe.
Nomination change is free. You can change it as many times as needed during the policy term.
